Divorce Tools

Alimony Buyout or Lump-sum Settlements

An important divorce settlement technique is evaluating alternatives to periodic taxable alimony in the form of an equivalent present, lump sum value. In many cases, lump sum settlement may be desirable for both payor and receiver over long drawn out and uncertain periodic alimony payments. The Buyout or Present Value calculation helps you determine how much to ask for or propose in lieu of monthly payments over a set period. With mEasysoft in your hand, you can simply plug in few values and compute lump-sum equivalents instantly. You can also email results.

Pension Valuation

Compute marital portion value of a defined benefit plan. Simply enter basic data such as dates for birth, marriage, plan participation, valuation date, monthly benefit amount, cost of living adjustments, retirement age, interest rates and pension value becomes available. Generationally adjusted RP-2000 life expectancy tables are used for gender specific pension valuation. You can also email results.

Alimony Recapture Value

If alimony payments decline too quickly over the first three years, alimony recapture might be required, in which case, some of the alimony payments will be re-categorized and tax deduction/payments will be eliminated.

With mEasysoft, you can instantly calculate the Recapture applicability and associated tax burdens/benefit to each party. You can also email results.

NJ Support

NJ Child Support

New Jersey support calculations are complicated and can be tricky at times, even for seasoned family law attorneys. With mEasysoft, you can now calculate New Jersey child support on the go, cut down on arguments and get both parties on same page, quickly. mEasysoft is a perfect companion to NJ CIS, New Jersey’s most popular family law program.

How Accurate is mEasysoft?

Very accurate. We have compared the results from hundreds of calculations with NJ’s CIS calculator and got almost identical results.

mEasysoft calculations account for the following:

  • Uses current year’s Federal & State tax tables based on 1040-ES charts
  • Alimony amounts are not applied with FICA tax
  • Applies teenage adjustment (Children over 12)
  • Non-custodial overnights credit
  • Sole vs. Shared parenting worksheet
  • Childcare expenses incurred by both parties including application of federal tax credits
  • Healthcare expenses incurred by both parties
  • Equal parenting support reduction is automatically applied per Deffler vs Deffler case
  • Self-support reserve test

Additional Features

Another great mEasysoft feature is that supporting details, worksheet alerts (e.g. income above support table limits or amount of teenage adjustments, etc.) display in a separate “Details” section. You can also email the Details section from the mEasysoft app.

Some App Limitations

You should be aware that there are certain limitations inherent in mobile platforms. mEasysoft currently does not have provisions to account for:

  • Mandatory retirement contributions (However, you can reduce income to account for the contributions)
  • You cannot allocate children’s tax exemption to parties. Calculations presume that the custodial parent will claim tax exemptions.
  • Other dependent deduction calculations
  • Government benefits received for child(ren)
  • PPR household income test for applicability of shared parenting worksheet

As you perform calculations, also be aware that:

  • Overnights between the custodial and non-custodial parent are assumed to be a total of 365.
  • Program uses IRS and NJ 1040-ES tax tables for the current year (usually updates in the first week of January). Because the New Jersey Guidelines combined tax tables for the year (IX-H) are typically released in March/April, you will see some tax discrepancies until Easysoft Legal Software’s desktop program is updated in March/April. Note that Guidelines released in March/April are still effective from January 1.
  • The equal parenting adjustment (Deffler vs Deffler) is deducted from the support obligation automatically. In the NJ guidelines, there is currently no provision for the adjustment. Desktop CIS software calculates the amount and shows it in comments, but does not reduce the support amount automatically.
